Terms of service

§ 1 Scope of application

The following terms of use shall apply to the use of this website in the relationship between the user and the operator of the site (hereinafter referred to as the provider). The use of our service is only permitted if the user accepts these terms of use.

§ 2 Registration, User account

(1) The prerequisite for using the service is registration and subscribing to either the free plan or a plan with costs.

(2) There is no entitlement to a user account and/or a subscription.

(3) The user may not allow third parties to use his access. The user is obliged to keep his access data secret and to protect it from access by third parties.

§ 3 Services of the provider

(1) The provider allows the customer to use the action endpoints in his web forms within the scope of these terms of use. The service provides backend endpoints for static web forms, so that the customer does not need to run own backend server infrastructure. Form submissions are emailed to the customer and/or stored in an archive for the customer to access. The provider undertakes everything in his means to keep the service online and available. However, the user is not entitled to permanent availability of the service.

(2) The provider is not liable for the service's reliability, availability and usefulness.

§ 4 Disclaimer

(1) Claims for damages by the user are excluded unless otherwise specified below. The aforementioned exclusion of liability also applies to the legal representatives and vicarious agents of the provider if the user asserts claims against them.

(2) Excluded from the exclusion of liability specified in passage 1 are claims for damages due to injury to life, limb, health and claims for damages arising from the breach of essential contractual obligations. Material contractual obligations are those whose fulfilment is necessary to achieve the objective of the contract. Also excluded from the exclusion of liability is liability for damages resulting from an intentional or grossly negligent breach of duty by the provider, its legal representatives or vicarious agents.

§ 5 Obligations of the user

(1) All user actions have to follow good morals and applicable law. In particular, the user does not use this service to
  • commit a criminal offence or misdemeanour,
  • to violate copyright, trademark or competition law,
  • to violate the Legal Services Act,
  • or to publish insulting, racist, discriminatory or violence-glorifying content.

(2) In the event of a violation of the obligations from paragraphs 1, the provider is entitled to modify or delete the corresponding user account and to block the user's further access. The user is obliged to compensate the provider for the damage caused by the breach of duty.

(3) The provider has a claim against the user to indemnification from claims of third parties, which these assert because of violations by the user. The user supports the provider in defending against such claims. The user is also obliged to carry the costs of a legal defense for the provider.
